Getting into the Swing of Things

Ventura Jazz OrchestraIt’s good to have Alistair Greene back after hitting the road with Mickey Thomas and Starship earlier this month. Thomas is the voice behind such hits as “Jane,” “Find Your Way Back” (Jefferson Starship), and “We Built this City” as well as “Sara” (Starship). Greene told me, “I’m very fortunate to have the chance to play with such a legendary singer and band as Starship featuring Mickey Thomas. I’m filling in for my buddy John Roth who is on tour with Winger at the moment. Mickey and the band sound amazing, and it’s a blast playing all those great hits from his career. He still sounds like he did in the 70s!”

Nothing like a big band dance to get you into the holiday spirits! Ventura Jazz Orchestra’s Holiday Swing soiree with the vocal stylings of Donna Greene will be at the Poinsettia Pavilion on Friday, December 5, featuring great songs from all eras you can dance to. Call for ticket information at (805) 648-1143.

Speaking of a throwback to a “simpler” time, The Saloon BBQ at 456 E. Main Street will be throwing a bash also on Friday, December 5, with a Prohibition Repeal party, “The 21st Amendment Jubilee”. There will be beverage specials all day long with live music starting at 8:00 with The Rachel Sorsa Band and their 1930’s style of jazz.

Chris Jensen from 50 Sticks of Dynamite gave me the head’s up about a project he’s been working on with fellow Ventura musicians, Evan Gosworth, Roy Katnic, Paddy Marsh, Brad Strickland and Gary Sula-Goff. It’s a Grateful Dead tribute band called Nine Mile Skid. They have a couple of dates lined up including December 10 at Green Art People, then on December 28 at Amigos’s on Main Street.

Under new ownership, Rock City Studios in Camarillo will be pulling out all the stops for their grand re-opening on Friday, December 5, with the national touring act, Dead Sara. The Galvanized Souls will open the show.

The Golden China is offering more music more often along with their nightly Karaoke. Thursdays continue to offer swing, Fridays have a DJ with Cumbia music and now Sunday evenings will be devoted to Reggae. Don’t forget they have an open mic night Tuesdays starting at 6:00 with the back line provided.

The whole family will enjoy the street fair along Main Street in downtown Ventura on December 6. What a great way to get unique gift ideas for the holidays including the highly prized VenturaRocks.com t-shirt! The Winter Wine Walk kicks off at 4:00 with snowfall at California and Main beginning at 6:45. Music will be provided by The Bomb, The Midnight Band and the British Beats.

And finally, congratulations to Todd Hannigan on his recent marriage to artist Brigette Lopez. They tied the knot in November in Ojai. I can’t wait to hear the music she’ll be inspiring out of him!

Brothers GowVentura Music Week doesn’t roll around until June, but a couple of meetings have already taken place and though the City hasn’t offered a budget to help out, we’re moving forward with several fundraising events taking place over the next few months. With a shoestring budget in the past and a handful of volunteers, this event has shaped up and grown over the past couple of years but there is much work to be done to achieve the committee’s vision. And yes, while it is a celebration of how cool our music scene is, it’s more about getting the word out about what Ventura has to offer not only to visitors, but to our own community. Our venues should be packed. Our artists should be celebrated and supported. That is the purpose behind this event.

Brothers Gow will return to Ventura in support of their 4th studio release, “Reflections” at Bombay’s on Thursday, November 20. The band’s high energy eclectic fusion of rock, funk, jazz and reggae is totally contagious. I recent spoke to Kyle Merrill (guitarist for Brothers Gow) about their return to our fair city and I asked him about what people can expect at the show and Merrill said, “We love to make people dance! We have an energetic stage presence fueled by powerful vocal harmonies, complex arrangements, and ripping guitar solos. To top it all off we have an awe inspiring light show run by our very own Matt Collier AKA MC6.” You can see complete interview at VenturaRocks.com.

The 14th Annual 4-Kids-2Kids Toy Drive will be held on November 22 at the all new Ventura Beach Club at 281 West Main Street. The music lineup features some of our favorite musicians including Ray Jaurique and the Uptown Brothers, Tommy Marsh and Bad Dog, The Guy Martin Band, Mojo Filter, Preston Smith and harmonica wizard Jon Gindick. Special honorary guest will be Nick St. Nicholas, founding member of Steppenwolf. A ten dollar cover and a new unwrapped toy will get you in the door.

The Ventura Harbor is once again offering their “Wine, Dine & Jazz” series through the month of November on Sunday afternoons Noon – 3 pm. You can still catch Hans Ottsen & Friends on the 16th and Justin Claveria Trio on the 23rd.

I’m looking forward to one of my favorite events of the year the Ventura Winter Wine Walk which is coming up on Saturday, December 6, downtown Ventura. The day begins with a street fair at noon with vendors and live entertainment (free to the public) and then the wine walk commences at 4:00 with snowfall at California and Main streets from 6:45 to 8:00. Musical entertainment will come from The Bomb, The Midnight Band and the British Beats. If you’d like more information and or to get your tickets before they sell out, go to www.VenturaWinterWineWalk.com.

And finally, congratulations go out to Discovery for getting through the City’s permitting process. Now let’s get back to having live music, permanently!

Army of FreshmenChris Jay of Army of Freshmen is totally looking forward to their upcoming UK tour with the band Lit. Jay told me, “I just love being on tour. We don’t get to do it nearly as much as we used to so I think we tend to enjoy it more and appreciate it. Every night is like a big party. It’s more like vacation than work.” The dates in the UK run from November 13 through the 23 so it looks like the guys will be back in time for Thanksgiving. See complete interview with Chris Jay at VenturaRocks.com

No news yet on the Discovery entertainment permit appeal. We have our fingers crossed this matter will be settled sooner than later and with Discovery retaining the right to have live music in their venue.

Way to go for The Velveteen Band who has been invited to play the Steampunk Worlds Fair in Piscataway New Jersey. The SPWF is the world’s largest gathering of steampunks. After only six months of being a band, the Velveteen has gained national attention with their Puppets, Rabbits, and big rock band sound. You can find them playing locally at Bombay’s The Dia de los Muertos, Day of the Dead, party on November 1 with Cirque Noir, Angie’s Curse and Fangboy and the Ghouls.

Kelly’s Lot will be holding a fundraiser for one of Kelly Zirbe’s favorite charities, C.A.R.L. at the Patio at The Player’s Club which will raise money for Canine Adoption and Rescue League. Look for appearances by Teresa James, Guy Martin, Steve Hinojosa, Lenny Mazzotti and Bobby and lee Orgel. The event will be held on Saturday, November 8 from 6 – 10 pm. $10 donation plus 15% of food sales donated.
Looking forward to hearing the new song that 8Stops7 has been recording. Bass player, Cory Tarallo, says, “This song is straight up awesome!” I can’t wait to hear “Center of Our Universe” after they put on the finishing touches.

Jan McWorter of Hi Hat Entertainment reminded everyone, “When one door closes, another one opens,” after Hi Hat said goodbye to over six years at Yolie’s on October 17 with the R&B Bombers. But after just a couple days of searching they found their new location just a stone’s throw away, at the newly renovated facilities at 281 W. Main Street at Ventura Beach Club (formerly Fuegos). Just a quick head’s up as Ventura Beach Club already had a previous obligation, on Halloween, Hi Hat’s James Harman party will be at Peirano’s on October 31.

There will be a cool fundraiser at Bombay’s on Saturday, November 1, to help raise funds for Dawn (single mom) and Damian (7 years old) and their battle with Cancer. There will be lots going on all day but on the music side of it there will be Alastair Greene, James Harman, Morganfield Burnett, Hot Roux and more.

And finally, I’d like to wish Ken Winters, “Happy Birthday!” Ventura’s jazz scene will be helping to celebrate his 88th birthday on November 4th during the bi-monthly jazz jam at Squashed Grapes. I’m sure cake will be involved.

October’s Rockin’
by Pam Baumgardner

Pam@VenturaRocks.com

McEuen FamilyIt turns out that this is my one-year anniversary writing for the Ventura Breeze.  Yay! Thank you Sheldon for designating the highly-prized back page for music. You rock!

Nathan McEuen’s Tuesday evening residency at Amigos is always a treat, but October 7, he stepped it up several notches when he performed with not only his brother Jonathan, but with their dad, John McEuen of the Nitty Gritty Dirt Band.  While it was cool, hearing them perform, it was even cooler seeing the admiration they have for one another.  Looking forward to hearing the new album Nathan has been diligently working on; he hopes to release it sometime in November.

I’m always tickled when I’m approached for talent advice for events being planned; case in point, Charleen Mora (Dirty Rice) of the Ventura Chamber of Commerce was searching for a jazz trio for the upcoming TASTE event being held October 30.  I’m pleased as punch to say The Hans Ottsen Trio will be performing.  TASTE will be held at the Museum of Ventura County this year with over 40 exhibitors and some exceptional jazz.

Taylor Rae returns to Bombays.  I happened upon her the last time she played there and immediately became a fan of her southern rock music with a tinge of blues.  She’ll perform earlier in the evening on the 18th for an all-ages show at 8 pm.

On the Grape front: The Pulse Daddies comprised of Trey O’Toole (Pulse Drumming), Karl Hunter and Dirk Shumaker (Big Bad Voodoo Daddy), and Hans Ottsen are on the bill for Oct. 16. Donna Deussen & the Paul Weitz Trio return on the 18th and of course Doug Webb Quintet with Danny Carey of Tool on the 24th.  And though I’m glad other publications are finally recognizing a “rebirth” of America’s original art form in Ventura, I would like to go on record as saying our  jazz scene returned two years ago when Squashed Grapes started providing consistent high caliber jazz artists Wednesday through Saturday with a jazz jam every other Tuesday.

I’m loving the community support for The Baker Family as traditional media and social media have been getting the word out on how to help them rebuild after their incredible losses. Discovery Ventura is hosting a fundraiser on October 26 with Raging Arb and the Redheads, Zepp Heads and Good Deeds.  Suggested donation is $10, but you can always dig deeper and give more.

And finally, because it falls on Friday this year, you know Ventura will be off-the-hook with Halloween parties.  Most venues are pulling out all the stops hoping to pack their joint with revelers.  From Amigos on Main to Billy O’s midtown to The Garage on the East end of town, live music will abound.  Dirty Rice will be at Discovery, The Bomb at the Watermark, Smooth Hound Smith at Red Cove, The UnUsual Suspects at Keynote,  Tony Ybarra at Peirano’s and well, the list goes on and on.  Be sure to visit VenturaRocks.com for a more comprehensive listing.

(At press time, I was assured that Discovery would be having music for the Baker Family fundraiser and for Halloween but their entertainment permit is being appealed)

Lee KochCongratulations to Plan B Wine Cellars as they celebrate their 2-year anniversary with good food, wine and of course live music! You can “Toast the train” while listening to Cuppa Joe; dancing shoes and lounge chairs are encouraged.

Speaking of local wineries and music, Squashed Grapes welcomes back The Doug Web Group with Danny Carey of TOOL on drums. This one is guaranteed to sell out once again; it’s highly recommended you get your tickets sooner than later.

Bombay Bar and Grill has a number of events to look out for this month. Ones to Watch Productions present the Lee Koch Band, Derek Jennings & Zeke Berkley on Friday, October 3. There will be a fundraiser to benefit Notes for Notes and the Boys and Girls Clubs of greater Ventura featuring a performance by Sgt. Pepper on Sunday, October 12, 4-7 pm. And if you are a fan of reggae, you won’t want to miss Junior Marvin & Nappy Ridden on Friday, October 10. Marvin joined Bob Marley & the Wailers in ’77 and over the past few decades has played with Soja and O.A.R. His latest collaboration with Nappy Ridden joins the two forces for Foundation to Creation supporting the creation of a new American reggae sound, steeped in funk, soul and rock.

One of my favorite annual fundraisers is Pier Under the Stars where local restaurants, breweries and wineries offer very nice samplings. The event is down next to the pier on Saturday, October 4 with music from Caliente. This one always sells out so get your tickets while they last at www.PierIntoTheFuture.org.

I’m pleased as punch that Monday, September 29, Ventura’s City Council unanimously approved the pilot concert series license agreement with Fitzgerald-Hartley Company and Nederlander Concerts for 2015.  As Councilman Tracy put it, “The proof will be in the pudding”, which is true, but the potential is so exciting!

The Majestic Ventura Theater has been busy booking shows for October: Jimmy Eat World on 10/2; The Aquabats on 10/4; The Dirty Heads on 10/10; Belanova on 10/11; Joey Bada$$ on 10/16; Matisyahu on 10/21; Ab-Soul, Simply Ty & Geezus on 10/24 and Erasure on 10/26.

If you’re a fan of Buffalo Springfield, Poco and Loggins & Messina, you won’t want to miss out on a special performance called, “An Evening with Jim Messina with Rusty Young ‘Sittin’ In’” on Saturday, October 11 at Ojai’s Libbey Bowl. A former resident of Ojai, Messina will be back treating fans with their hit songs while fundraising for Community Memorial Health System construction projects in Ojai.

And finally, Ventura Rocks will be amongst the vendors 4-6 pm on Sunday, October 4, hoping to raise funds for Strides Against Cancer at Amigos. Local artists, Karen Eden and Joe Hamilton, will be donating their time and The Tossers will perform afterwards at 6 with British cover tunes.

Calire's Hammand B3I seriously can’t remember a year with more music bursting at the seams than this past year, and we’re only about two thirds done! Coming events, and starting on the water, the Ventura Harbor is capitalizing on all this great weather by bringing back the popular Rock on the Dock series every Saturday in September. Still to come on the 20th is Smokey and Friends and the 27th The Hard Times Band.

The 2014 California Beer Festival is finally upon us. I’m looking forward to learning all about craft beer on Saturday the 20 while chillin’ to Petty Theft, Dr. M and Rey Fresco; and then on Sunday, the 21, it’s the Blues & BBQ Festival with Tab Benoit, Trampled Under Foot, Sister Sparrow & the Dirty Birds, Michael John & the Bottom Line as well as Jonathon Boogie Long. I’ll be out selling Ventura Rocks t-shirts on Sunday, so be sure to swing by and hang a spell.

A free family-friendly night of music featuring music from popular radio and Broadway will be held at the Ventura Theater on September 19 and 21 featuring Loanne Wullaert with vocal support from some of the county’s best vocalists including Aaron Orbit and Marcella Tambouris. Look for numbers from Les Miserables, A Star is Born, Frozen, Dreamgirls and more. In between the two nights being called “September Song” will be The White Buffalo on the 20th. See VenturaTheater.net for times.

The good folks from Zoey’s have officially kicked off their new music venture in the form of Ones to Watch Productions. Steve and Polly Hoganson continue their support of up and coming artists as they produce local showcases. The next one will be Friday, October 3, at Bombay Bar and Grill with The Lee Koch Band, Derek Jennings and Zeke Berkley. For more information see OnesToWatchProductions.com.

One of my favorite blues singers with some serious spunk is Kelly Zirbes who has this never ending contagious energy about her. She’s always there when a helping hand is needed and it’s always a treat to see Kelly along with her husband Perry Robertson and their band Kelly’s Lot perform. She’s sure to make you laugh, but more than that, the band will get you up off your tush jamming to their special brand of rockin’ blues. Kelly’s Lot CD release party for their latest CD, “Don’t Give My Blues Away” will be held on Friday, September 19, at Yolies with a $10 cover. If you’re not able to make it, you’ll want to add this one to your collection for sure. Visit KellysLot.com to pick one up today.

And finally, just a quick little anecdote: While hanging out with Jimmy Calire the other night at Squashed Grapes, I knew the Hammond B3 organ he had brought in for the show that evening with Karl Hunter had some stories behind it, but none could be cooler than the one he share with me that evening where he would be jamming on it with his band, Raven at The Session in the Theater District in New York City and Jimi Hendrix would jump up on stage and join in the action. Seriously, how cool is that? This town has such an abundance of talent and history reinforcing what I’ve always said, Ventura Rocks!

Ventura Summer One for the Books
by Pam Baumgardner
VenturaRocks.com
Pam@VenturaRocks.com

Pam Baumgardner & Danny CareyWho called it?  Yeah you got that right. I did when I speculated that the Doug Webb Group would be another one for the books because they absolutely killed it at Squashed Grapes Saturday, August 26 with special guest Danny Carey of Tool on drums.   Carey told me that he doesn’t frequent Ventura all too often, but he recollected playing the Ventura Theater with Tool, and of course visiting his bud Terry Bozzio (Missing Persons) who lives nearby.  He clearly was having a great time navigating through the jazz pieces Doug Webb had selected for the evening and even if I do say so myself, he nailed it. Carey goes out on tour with Primus next.  Webb of course is no stranger to the Grape, and it’s always a treat to have the guy who plays the saxophone of Lisa on The Simpsons in the house.  Plus having played with Freddie Hubbard, Stanley Clarke, Quincy Jones, and others to name but a few, is nothing to sneeze at. The house was comfortable sold out to capacity with a number of fans outside hoping to get a glimpse of Carey, and as the drummer is seated directly next to the front window, they weren’t disappointed.

And though school is back in session, Summer is far from over with several key events to look forward to including the Ventura Beach Party on September 6 and 7 down at the pier which has music both days and a Marathon which is a qualifying race for the Boston Marathon.  The following weekend, also down along the promenade is the Aloha Festival on the 13 and 14 with Dirty Rice performing on Saturday.   And then of course the ever popular California Beer Festival September 20 and 21 with Sunday featuring some killer blues acts such as Tab Benoit, Sister Sparrow & the Dirty Birds, and Michael John & the Bottom Line.

Look for the annual Key to the Highway Blues Benefit for Khepera House Rehab and Recovery program at Bombay’s on Sunday, September 7 with Tommy Marsh and Bad Dog, Brian Batchley & Friends, Guy Martin and 50 Sticks of Dynamite.  I’m also hearing there will be special guests showing up including Kelly Zires and Perry Robertson of Kelly’s Lot.  Kphepera House has been helping drug addicts and alcoholics and their family in Ventura County for over 30 years.

The White Buffalo was no stranger to Zoey’s and he even headlined Polly’s benefit last year; but now he’s stepping it up a notch (or five) with his appearance on the Jimmy Kimmel show August 27  and he’ll be headlining the Ventura Theater on September 20 in support of his most recent release, Shadows, Greys & Evil Ways.

And finally,on a very sad note, it is with a heavy heart we learned of the passing of Dan Wilson over the Labor Day weekend.  Ventura’s music community has lost a true gem.

This is a good time to give a gentle reminder to ALL musicians, fans, and media who support Ventura’s music scene:  we’re all in this together.   Enough said.

Ventura Music Just Keeps Rockin’

Jake OwenWho else was a little sad to see the fair close this year?  High on my list of favorite shows at the fair were Deep Purple, Beach Boys, Seether and I absolutely loved the Barenaked Ladies; but I admit, I was quite smitten by Jake Owen who packed in the arena with his brand of new Country.  Very well done Fair!

We said goodbye to Jeff Hershey and the Heartbeats as they did their farewell show for Music Under the Stars at Olivas Adobe.  Hershey was on fire and the boys in the band -better known as The Heartbeats – kicked it up a notched entertaining the crowd and going out in style.  Thanks for the memories guys!

Sometimes you just never know how cool it is (and a privilege I might add) to see someone play until you ask, “Who are these guys?”  Well I’m glad I did as the second act warmed up Friday, August 8, as a part of the Ones to Watch series at Bombay Bar and Grill.  I asked Steve Hoganson (Zoey’s) who the guitar player was and he told me Doug Pettibone plays guitar for John Mayor.  Cool, right?  But then he went on to inform me that his bass player, Taras Prodaniuk plays with Dwight Yoakam and drummer Toss Panos with Robben Ford.  What an amazing set these guys did too.

Alrighty then, let’s take a look at what’s coming up that you won’t want to miss.  August 23 and 24 is the 5th annual Spencer Makenzie’s End of Summer Block Party.  Once again shutting down the city block outside Spencer Makenzie’s Fish Company, the event features two stages of music from the likes of Aaron Orbit, Derek Jennings, TresCoustics, Rey Fresco, Shaky Feelin’, Ventura Social Club, Resination and  The Ska Daddyz.  There will be tons of music both days along with their famous Throw Down (corn hole) tournament for some nice prize money.

And then for three days over Labor Day Weekend, August 29 through August 31, it’s Bombay’s 30th annual Beach Party where they bring the beach to the bar creating one heck of a party, with over 25 bands and 6 DJs featuring all genres of music.  With three stages of music (inside and out), the party will feature appearances from 8Stops7, The Rubberneck Lions, Bloody Mary Morning, New Liberty, Mandex, Raging Arb and the Redheads, Rey Fresco and tons more.

And then finally, Rachel Flowers will be giving a free concert at Ojai’s Libbey Bowl on Sunday, August 24, as a part of the ongoing documentary being produced by local filmmakers.  Flowers is an amazing talent who has been blind since birth and playing music since the age of four. Take the family and be a part of this incredible event. Concert starts at 6:30 pm.

A Photographer’s Rights

The photographerOkay, let’s talk about a photographer’s rights.

But before we do, and before we get anybody’s panties in a bunch, I want to put out there first and foremost, SHARE my photos. I have never turned down anyone’s request to use my photos for their own promotion of their band or for their venue or just for fun. NO ONE.

Also, I would like to note that most musicians and venue owners are incredibly sensitive to this issue and go above and beyond the call of duty when using a photo I’ve taken.

So here’s what inspired this post: today while perusing my Facebook News Feed, I spotted one of my photos I had taken over the weekend, but something did not look quite right. The colors were faded and it had been cropped.  Honestly, I can live with that. The faux pas? This individual cropped off my watermark, and they didn’t give a photo credit or a thanks for the photo. THEY CROPPED OFF THE WATERMARK.

I have no doubt that this person had no idea they had offended.  I’m certain that there was no malice in their action.  I’m sure they thought it completely harmless and probably didn’t even realize they had done anything wrong, and for that, I don’t take this personally; but I have had discussion with photographers on this very matter.  Also, I know there are a small handful of musicians who are not clear on who owns the photo of them. So I thought I would take a moment and talk about etiquette and a little bit about copyright laws when it comes to photography.

I’ve seen photographers give long-winded notice that their photos are copyrighted and how you may or may not use their photo and blah blah blah.  Honestly, if I were that worried about people using my photos incorrectly, I would never post them on the internet let alone Facebook!

At first I thought professional photographers shouldn’t even post their photos because there is no way you can police everyone on the internet.  But then I realized that they could use Facebook as a tool to show off what they are capable of creating in the hopes of getting hired someday.  I truly believe that professional photographers deserve to be paid for their art; just as musicians should be compensated for theirs.

I asked a professional photographer friend of mine if this happens to her and she pointed out it happens all the time when people use one of her photos for their profile shot.  I can now hear most people asking themselves, “Holy shit! Have I done that???”

You know I don’t expect to make my living off the photos I take.  I do what I do to help promote Ventura’s music scene. AND, on the very limited occasions I have posted a photo on VenturaRocks.com that was not taken by myself, I first asked for permission, and then I give the photo credit.  The same with my article in The Ventura Breeze.  I basically watermark to further the promotion of Ventura’s music scene. I don’t use my personal name, Pam Baumgardner.

I post photos one of two ways, either directly from my crappy camera phone which I haven’t figured out how to watermark, or I post photos I’ve taken with SLR Canon which I’ve cleaned up and watermarked with “VenturaROCKS.com”.  So it came as a big surprise to me when I saw the photo cropped and no photo credit given.  Couldn’t they have just “shared” it?  That would have shown where they got the photo from.

The bottom line? I am the copyright owner of every picture I take, watermarked or not.

Kodak wrote an article on Copyright Guidelines. I’m going to copy and paste two particular sections:

Who Owns What?

The law says the “author” is the owner of the copyright. The author of a photo or image is usually the person who snapped the shutter or created the image. If you took the photo, you own the copyright. If a professional photographer took the photo for you, then he or she owns the copyright. If that photographer is an employee of a studio or other person in the business of making photos, then his or her employer is considered the author.

Prior to 1978, court cases said a customer who commissioned a photo was the employer of the photographer, so customers could get reprints made without any problem. In 1979, the U.S. Supreme Court said that was no longer true. To be an employee, the court said a person would have to be considered an employee under the traditional tests such as are used to impose payroll taxes, social security, and similar laws. That is not the usual customer-photographer relationship.

What Is Copyright?

The U.S. Constitution and the Federal Copyright Act give “copyright” protection to “authors” for their “original works,” such as photographs. Among the protections that copyright owners have are the exclusive rights to:

Make copies of the work
Prepare other works based on the original
Distribute copies of the work to the public by sales, rental, lease, or lending
To publicly perform and display the work.
These rights are protected by laws which provide for damages and criminal penalties for violations. Both the customer and the lab are subject to the law.

The point of this editorial is not to berate offenders of this rule…make that law; the point of this article is to educate.  That is all.

I understand the confusion, after all it’s the person’s image for crying out loud.  I understand why a musician would think they have the right to use that photo, it’s them!!  But the law states the photographer owns the right to the picture, not the subject, so it’s not only common courtesy to ask for permission to use it for promotional purposes, but it’s actually the law.

Amazing photographer Amanda Peacock

Amazing photographer Amanda Peacock

So to all my photographer buds, I got your back.  And to all my musician friends, I got your back too.  This editorial is to help you better understand the laws on the photographs that are taken of you. I know that you want the promotion that photographers give you. There are quite a number of awesome photographers here in Ventura who help spread the word about your music. I would list them, but I know I would leave someone out by accident.

And as for the legalities of taking pictures?

“Anyone in a public place can take pictures of anything they want. Public places include parks, sidewalks, malls, etc. Malls? Yeah. Even though it’s technically private property, being open to the public makes it public space.” *

Of course I’m not naming names.  I’m not even going to contact the musician who was the catalyst of this piece. If you know who it was, please don’t embarrass them.

I am here to serve this incredible music community.  And again, helping musicians better understand a photographer’s rights, only helps serve them better in the end.

I’ll be honest, I was not familiar with Casey Abrams until Adam and Josh, the owners of Squashed Grapes, informed me that they had booked Abrams for a show, which was to be on the “downlow.” They said to YouTube “Casey Abrams and the Gingerbread Band,” so I did and within the first few notes I could see what the fuss was all about. Abrams played to a sold out show Saturday, July 26, which was solely done by word-of-mouth. Viewers of American Idol will remember Abrams from season ten, and although he didn’t win, the audience fell in love with him.

Self taught on eleven musical instruments, and by ear, the man clearly has talents, including what could possibly be the world’s biggest flirt (see photo).  Abrams told me they did the Squash Grapes gig without any rehearsal.  He explained, “It’s a giant experiment. We were actually supposed to have a trombone player/keyboard player with us tonight, but he couldn’t make it. So we decided to not replace him and to just be The Gingerbread Band.  We said, ‘Let’s see what we can do with just horns, bass and drums.’ It feels really good. It feels good to rock hard.”

And rock hard they did.  I have to admit it was one of the coolest nights of music ever and has earned a spot on my Top Ten favorite shows list.  That being said, I may be adding another show soon as I recently learned that Squashed Grapes has an ever bigger attraction on the books, Saturday, August 23, Doug Webb featuring none other than Danny Carey of TOOL will be in the house.  Yeah, you heard it here.

Speaking of rocking hard and I mean REALLY HARD, Chiodos played the Ventura Theater Friday, August 1.  The band is based out of Davison, Michigan, and just released their fourth studio album.  They have had some personnel issues over the years, but Craig Owens is back as their lead singer, and their fans couldn’t be happier.  Bradley Bell, keyboardist, told me about the new record “Devil” and how they released it on 4-1-1-4, which of course was April Fool’s Day, but he swears it wasn’t planned out that way.  There were label issues, and they were finally able to release it having to persuade fans it wasn’t an April Fool’s joke that Owens was back on board.  I sat down with Bell before their show to talk about “Devil.”  Bell said, “The release went really well, above our expectations and we have a new music video coming out in the next couple of weeks so there’s a lot of exciting things coming up.”  Chiodos is currently co-headling with Blessed the Fall.

Hot off of two huge tours backing Jennifer Lopez and Stevie Wonder this summer, Fausto Cuevas stopped in town for a free show at Pancho’s which is located in the former Zoey’s spot.  It’s small, intimate, and honestly who would have thought you’d find Cuevas there; but Ventura is just that cool of a place for this caliber of artist to come play.  The room was packed and the Latin jazz was hot!

Music Under the Stars at Olivas Adobe continues to entertainment to the delight of concert goers.  Don’t forget it’s the final show for Jeff Hershey and the Heartbeats on August 9 when you know Hershey will pull out all the stops. The following weekend you can take in the Neil Diamond tribute band on the 16th, and then the next afternoon at 1:00 the Ventura County Blues Society presents Rod Piazza & the Mighty Flyers.

And finally the concert lineup is as popular as ever at the 2014 Ventura County Fair.  Music lovers were thrilled to see actor John Stamos join the Beach Boys last week, which was cool and got the girls hooting and hollering, but it was extremely cool to have David Marks back playing with the band.  There’s still plenty of music to come and I’m looking forward to catching Deep Purple, Seether and Jake Owen
